Gender-Based Violence Offences
The criminal proceedings began following a complaint filed by our client’s wife, who claimed to have been assaulted by him. The Public Prosecutor’s Office requested a one-year prison sentence for our client.
However, despite not having any eyewitnesses to the events, we were able to highlight the lack of consistency and continuity in the complainant’s account. Specifically, during her interrogation, as well as in the final report phase of the oral trial, we highlighted the contradictions and inconsistencies in her account.
In addition to the above, we provided documentary evidence demonstrating that, in the complaint filed against our client, a spurious motive resulting from the conflict over the breakdown of the relationship between the complainant and the accused could not be ruled out.
For all these reasons, our client is acquitted of the charge of domestic abuse .
