This type of crime, which, as we have seen, carries a lesser penalty than the generic forms of theft and robbery, can only be assessed if the perpetrator of the theft returns the vehicle within a period of no more than 48 hours . Both direct restitution (i.e., personally returning the vehicle to its rightful owner) and indirect restitution (for example, returning the vehicle to its location or leaving it in another location where the owner can easily recover it) are permitted.
This modality is not applicable when, despite the aforementioned circumstances, the theft or use of the vehicle is carried out using violence or intimidation against people, even if there is no intention of appropriation on the part of the perpetrator and the vehicle is returned within forty-eight hours.
