After receiving a court summons as a suspect for fraud , we held an initial in-person meeting with the client to inform him of the steps to follow for his best criminal defense.
First, we filed a written statement of appearance with the court that handled the case, requesting a copy of the entire file for thorough review and preparation of the statement the client must provide before the judicial authority.
After reviewing the case, we met with the client again and concluded that his personal data had been stolen and, through the illicit use of that data, a third party had perpetrated several frauds on our client’s behalf.
Based on the above, we carefully prepared the statement he was to give before the investigating judge and subsequently submitted a document requesting several investigative proceedings into the facts, all aimed at proving the innocence of our client, who was, in fact, just another victim of the events under investigation.
Contrary to the findings of the police officers in charge of the investigation, through the written investigations we requested, we were able to prove that our client had no involvement in the commission of the events under investigation.
Consequently, we requested in writing that the case against our client be dismissed, arguing that this request was based on the results of the investigative proceedings we had requested, which, in our opinion, demonstrated our client’s innocence without requiring him to be brought to trial.
And, upholding our claim, the investigating judge issued an order dismissing the proceedings and closing the case against our client.
