The Public Prosecutor’s Office charged our client with a crime against public health (drug trafficking) involving substances that cause serious harm to health, as provided for in Article 368.1 of the Criminal Code , and requested a sentence of 4 years and 6 months in prison, as well as a fine of 3,000 euros.
Specifically, our client was accused of possessing a certain amount of cocaine for trafficking purposes.
Our line of defense consisted of highlighting the insufficiency of the evidence to conclude, beyond any reasonable doubt, that the drugs attributed to our client did indeed belong to him. In our view, and as subsequently reflected in the sentencing, the evidence presented at trial was entirely insufficient, as it was impossible to determine who owned the drugs that were found and that, initially, the police officers, and later the Public Prosecutor’s Office, attributed to our client.
Thus, after the presentation of evidence, consisting of the questioning of witnesses present at the scene of the crime, as well as the police officers involved, we were able to highlight the weaknesses of the prosecution’s case and, thus, obtain our client’s acquittal.
In this successful case, we obtained the acquittal of a client convicted of drug trafficking and electricity fraud.
